Voices against the government. Not sedition: SC – next IAS

In the news: Recently, the Supreme Court dismissed an application for treason charges under Section 124A of the IPC against former Chief Minister of Jammu and Kashmir Farooq Abdullah after repealing Article 370 of the Constitution.

Background

  • Petitioner accuses Dr. Abdullah of making remarks during his speech that “he will restore Article 370 of the constitution with the help of China.”
    The petitioners said that the statement was “traitorous” and that he was spreading anti-national sentiments in the minds of innocent people of Jammu and Kashmir.
    Supreme Court: A bench headed by Justice Sanjay Kisan Kaul said there was nothing in Dr Abdullah’s statement that “we find it so objectionable to give reasons for taking action to start court proceedings”.
    Expressing dissent with the decision taken by the central government cannot be termed as sedition.
    The bench dismissed the case against the petitioners for spending Rs 50,000 to be deposited in the Advocates Welfare Fund within four weeks.
